Introduction

These Terms and Conditions govern your access to and use of the Performance Rebuilt Aus fitness coaching platform. These Terms constitute a legally binding agreement between you and Performance Rebuilt Aus, operated under ABN 88 571 749 763. Access is granted only upon your explicit acceptance of these Terms, the Privacy Policy, and the Liability Waiver during account activation.

These Terms are also subject to the Fair Trading (Fitness Industry Code of Practice) Regulations 2020 (WA). A copy is available at consumerprotection.wa.gov.au.

Eligibility

• Be at least 18 years of age
• Be a resident of Australia or another jurisdiction where the Platform is available
• Have received an invitation from a Performance Rebuilt Aus coach
• Complete the mandatory PAR-Q health screening before program access is activated
• Provide accurate and complete registration information
• Not have been previously suspended or removed from the Platform

Account Access

The Platform operates on an invite-only basis. You must not share your login credentials with any other person. You are responsible for all activity that occurs under your account. Where access is revoked due to our breach or a change in service availability, any prepaid unused fees will be refunded on a pro-rata basis.

Platform Availability

• The Platform may be temporarily unavailable due to maintenance or circumstances outside our control
• We will endeavour to provide advance notice of scheduled maintenance
• We reserve the right to modify or discontinue Platform features with reasonable notice
• Upon termination, you may request a data export within 30 days by emailing performancerebuilt@gmail.com

Services

• Personalised training program creation and assignment
• Workout logging and tracking
• Nutrition and macro tracking
• Body weight and progress photo logging
• Direct messaging and flagging between coaches and clients
• Goal tracking and progress analytics

Nothing on the Platform constitutes medical advice, diagnosis, or treatment.

Fees and Payment

All fees are in Australian Dollars (AUD). Payment terms and billing cycle will be confirmed in writing at onboarding. We will provide no less than 14 days written notice before any fee change. Late or failed payments may result in suspension of access.

Cancellation and Refunds

Your right to cancel

You may cancel at any time by contacting your coach in writing. Cancellation takes effect at the end of your current billing period.

Cooling-off period

In accordance with the WA Fitness Code, you have the right to cancel during the cooling-off period without penalty. Any fees paid will be refunded within 14 days. See consumerprotection.wa.gov.au.

Permanent illness or incapacity

You may terminate without a fee if you suffer a permanent illness or physical incapacity preventing use of the Platform. Reasonable evidence may be requested.

Australian Consumer Law

You may be entitled to a refund if the service is not fit for purpose, not of acceptable quality, or not as described. These rights cannot be excluded.

User Responsibilities

• Use the Platform only for lawful purposes
• Complete the PAR-Q honestly and update your coach if your health status changes
• Consult a qualified medical professional before commencing any exercise or nutrition program if you have health concerns
• Notify your coach if you experience pain, discomfort, or unusual symptoms
• Not share your login credentials or allow another person to access your account

Health Disclaimer

• You participate in any exercise or nutrition program at your own risk
• Performance Rebuilt Aus coaches are not registered medical practitioners, physiotherapists, or dietitians unless expressly stated
• Performance Rebuilt Aus accepts no liability for injury, illness, or adverse outcomes arising from use of the Platform, to the maximum extent permitted by law

Any general nutrition guidance follows the Australian Dietary Guidelines and does not constitute clinical dietary advice.

Intellectual Property

All content on the Platform is the intellectual property of Performance Rebuilt Aus or its licensors. You are granted a limited, non-exclusive, personal licence to access and use the Platform for your own coaching purposes only. You must not reproduce or distribute Platform content without written consent.

Limitation of Liability

To the maximum extent permitted by Australian law, our liability is limited to the total amount you have paid in subscription fees in the three months preceding the claim. We are not liable for indirect, incidental, or consequential losses. Nothing limits liability for death or personal injury caused by our negligence.

Dispute Resolution

• The party raising the dispute will notify the other in writing describing the dispute and outcome sought
• The parties will negotiate in good faith for 14 days
• If unresolved, either party may refer to mediation
• If mediation fails, either party may pursue legal remedies

Governing Law

These Terms are governed by the laws of Western Australia, Australia. Any disputes shall be subject to the exclusive jurisdiction of the courts of Western Australia.
