Liability Waiver

Nature of Services

Performance Rebuilt Aus provides online fitness coaching services, including personalised training programs, nutrition guidance, and progress tracking. Coaches are fitness professionals. Unless expressly stated, they are not registered medical practitioners, physiotherapists, dietitians, or allied health professionals. Nothing provided constitutes medical advice, diagnosis, or treatment.

Pre-Exercise Health Screening (PAR-Q)

Before being granted access to any training program, you are required to complete the PAR-Q provided during onboarding. Program access will not be activated until it has been submitted.

By completing the PAR-Q, you confirm that:

• You have answered all questions truthfully and to the best of your knowledge
• If the PAR-Q identifies health risk factors, you will obtain written medical clearance before commencing any program
• You will notify your coach immediately if your health status changes after submitting the PAR-Q
• You understand that providing false or incomplete information may result in your access being suspended

If you have a diagnosed medical condition, Performance Rebuilt Aus can only provide services if you present a medical clearance stating your conditions are stable and you are fit to participate.

Acknowledgment of Risks

You acknowledge that participation in physical exercise and changes to dietary intake carry inherent risks, including:

• Muscle strains, sprains, and other soft tissue injuries
• Joint injuries including to the knee, shoulder, back, and hip
• Cardiovascular events including elevated heart rate and in rare cases, cardiac events
• Dizziness, nausea, or fainting during or after exercise
• Aggravation of pre-existing medical conditions
• Adverse reactions to changes in nutrition or caloric intake
• Psychological impacts related to body image or performance pressure

Medical Clearance

• You have obtained, or will obtain, written medical clearance if you have any pre-existing conditions, injuries, or health concerns
• You are not aware of any physical condition preventing you from participating in moderate to vigorous activity
• You will immediately cease any exercise causing pain or unusual symptoms and seek medical advice
• You will inform your coach of any changes in health status

Release and Indemnification

To the maximum extent permitted by Australian law, you release, discharge, and hold harmless Performance Rebuilt Aus, its coaches, employees, contractors, and representatives from all claims arising from:

• Your use of the Platform or any services
• Your participation in any training program or nutrition plan
• Any injury, illness, or property damage suffered by you
• Any reliance on information or content provided through the Platform

Australian Consumer Law

Nothing in this Waiver excludes, restricts, or modifies any right or remedy implied or imposed by the Australian Consumer Law that cannot be excluded. Where it applies, our liability is limited to re-supplying the services or paying the cost of re-supply.

Assumption of Risk

You voluntarily and knowingly assume all risks associated with your participation in exercise and nutrition programs facilitated through the Platform.

Governing Law

This Waiver is governed by the laws of Western Australia, Australia. Any dispute arising shall be subject to the jurisdiction of the courts of Western Australia.

Client Acknowledgement
